looking over here, we have a live look outside where i'm seeing a smooth flow on the peninsula but a new accident, the second in the last 20 minutes. we'll give you the update ot nimitz coming up. >> like to keep it smooth and it feels smooth on a friday as we give you a live look over emeryville. how about that, ladies and gentlemen, on a friday, november 2nd. this is "today in the bay." straight up 5:00. good morning, everybody. thank you very much for joining us, i'm jon kelley. >> and i'm laura garcia-cannon. the cleanup after sandy is continuing this morning. >> new video released overnight by new york's metropolitan transit agency. you can see this once flooded subway is now empty but at this point not quite ready for service. meanwhile frustration growing as people trying to get into manhattan are now forced to deal with heavy traffic, large crowds at bus stops. in the city some people still without power and clean water. new york will send bottled water

and ready-to-eat meals to the hardest-hit areas this weekend. in nearby new jersey there's still long lines of people out there just trying to fill up their gas tanks. officials say there is plenty of gas but they can't get to the stations because they need electricity to try to unload it. amid all the mess, new jersey actually trying to make sure election day goes as planned. military trucks will serve as polling places now in some of the hardest-hit areas. and utility crews from all over the country converging on the northeast, trying to help. but one group is actually being turned away. crews from alabama were told they cannot do work in new jersey because they are not union employees. you'd think they could waive it for something like this. right now they're headed over to new york instead. >> we will hold a special telethon for the victims of hurricane sandy tonight. matt lauer will host the event and there will be performances from the likes of billy joel, sting and christina aguilera. you can see the telethon right

here on nbc bay area starting at 8:00 p.m. happening right now, chp officers joining forces with local police to patrol the streets of oakland. this happening as the city's police department deals with increasing violence and a possible federal takeover. christie smith is live in oakland with more on exactly how the joint patrols are going to work. christie, good morning. >> reporter: good morning, jon. this is a program that's been really successful in oakland before, putting chp officers on the streets to help patrol specifically in high crime areas. it comes at a time when the city of oakland could really use it. oakland is dealing with a 20% rise in major crimes this year and only have about 620 to 640 officers out there on the streets. four years ago that number was closer to 850. the chp and opd worked together before between 2007 and 2010. during that time violent crime went down, but there wasn't enough money to continue it.

exactly how it's funded this time is still unclear, but the program is back because the community put pressure on governor brown. former mayor here in oakland and the pastor of a church made a plea. >> we've done these details. a definite decrease in calls for emergency services, in violent crimes occurring, and we've also seen an increase in community relations. >> reporter: now, this deployment is expected to be similar to previous anti-gang efforts here in oakland. it's expected that this operation will last for at least 90 days with an option to extend it. meantime oakland is planning right now for three police academies. reporting live in oakland, christie smith, "today in the bay." it's 5:03. the man accused of killing his ex-girlfriend and her friend told a martinez jury he has no regrets about what he did. nathan burress is defending himself against charges he

killed debra roth and ersey everett back in 2009 at the richmo richmond-san mateo bridge toll. burress admitted thaef the shooter and said that he still feels hatred for the shooters. if convicted, burress would be eligible for the death penalty. laura, a man is alive this morning, saved after being alerted by his dogs. after he escaped his burning home, one of his dogs could not make it out in time. that fire broke out just before 9:00 at a townhouse complex on ivycreek circle. there were heavy fires in the bedrooms and the man's dogs barked loudly and woke him up. he did manage to escape with three of his animals, but one dog ran back into the bedroom and was ultimately killed by all the smoke. the cause of the fire remains under investigation. firefighters in san jose holding a memorial service for a cal fire battalion chief who died while investigating a fire in santa cruz county.

rob van warmer collapsed early last saturday and was taken to a hospital where he sadly died an hour later. that memorial service will be held at 10:30 this morning at the hp pavilion. we are now just four days away from the election and nbds bay area has learned an east bay county is dealing with a potential case of ballot tampering. marla tellez joins us in our newsroom with a story giving new meaning to the phrase dirty politics. >> reporter: it is certainly hard to make your vote count when your vote ends up in the gutter and that's exactly where a couple in vallejo say they found more than a few mail-in ballots. the couple say they were out for a balk when they discovered three soggy mail-in ballots in the gutter near their home a couple of weeks ago. just last week they found another voter's envelope ripped apart and this time the ballot was missing. they say they're disgusted and worried there could be more. >> i'm appalled. i'm appalled because i don't

care whether it's republican or democrat or independent or whatever it is, these people voted. they're americans and they voted and they have a right to vote and their vote has to be counted. >> it's one of your rights of being an american that you can right. they took that away from them. >> we went ahead and took the evidence to the registrar of voters in solano county and the deputy registrar said the office will do what they can to reach the affected voters. he says the ballots usually arrive in pristine condition and he calls the situation, quote, extreme. now, you can see this whole story on our website where we also have an entire section dedicated to decision 2012. our website of course is nbcbayarea.com. of course come election night we will have complete live coverage of local and national races. >> it is finally upon us. thank you. >> just days away the countdown continues. 5:06 right now. we get back with meteorologist christina loren heading into the weekend. it looks like it's going to be

nice. >> it is going to be nice. we've got a great-looking fall weekend shaping up. we want to start with this live picture over san francisco. nice and clear for now. we are expecting a little patchy fog but not a whole lot and temperatures are certainly cooler because we're starting out clearer this morning. no blanket of low clouds. 45 degrees in novato, 52 in san francisco and 45 to start. yeah, really comfortable in napa this morning. as we head throughout the morning we'll see temperatures creep up very quickly. the sun will be up right off the bat. i want to stop your futurecast right at 5:00 a.m. and you can see, look at this, system of low pressure just to our north. we've got high pressure keeping things mild today but it's a weak ridge. we're expecting the showers to start to push into the north bay. not expecting any activity to the south of the golden gate bridge until overnight tonight. you can see a little shower activity from santa rosa down through novato. san francisco staying dry at that point. stop the clock at 10:00 p.m., we're done with that shower chance and we'll see a very nice saturday and sunday.

we've got a warming trend in the very near future. it will be about 72 in gilroy, sent in concord and 76 in san francisco. your seven-day outlook ready to go. that's in my next report. first let's check on that drive on a friday with mike. >> first of all, happy friday, everyone. we're looking over here to the nimitz right by the coliseum. this is a beautiful view, a smooth flow of traffic. the warriors play tonight against the grizzlies so expect some game time traffic after work but not a big deal right now. farther south, northbound 880 at marina boulevard, the earlier accident has cleared from the northbound side without any further slowing. southbound we had two incidents reported. one 880 at 92, another at tennison so it should be a smoother drive to the san mateo bridge. looking at the east shore freeway coming toward us is your

holding formal talks. a recent report on espn says a federal mediator will not be brought in any time soon. not looking very hopeful there. 5:12 right now. it's a smaller size with a smaller price. just in time for your holiday dollars. apple's new ipad mini in stores this morning, and bob redell is live at apple store in los gatos this morning where ipad buyers have been in line for hours. a lot of folks out there, bob? >> reporter: demand isn't as great as let's say when the iphone 4s was released here in los gatos. that is what people are trying to get their hands on if you look at the wooden table and on the edge you have the ipad minis. buyers will be able to go in around 8:00 this morning. there's maybe about a dozen people out here in line. you've got this guy right here. he's got his snugee going on in his van trying to stay warm. you've got a few people, more people in the car. here's someone who's bundled up.

little expensive. the video is overseas when the ipad was released hours ago in tokyo. they had about 300 people lined up outside. the apple store here in los gatos, maybe about a dozen right now. we'll see if the crowd gets bigger when the store is going to open around 8:00. i'm trying to keep my voice down so i don't wake anyone up. let's bring in scott mcgrew. a much more understated debut. >> it really is. i was trying to think of the best apple christmas or hannukah ever. the iphone, the ipad mini and the ipad. a little red ribbon, wouldn't that be outstanding? there is a version of this is pad mini which connects to the cell phone network. that one isn't available yet. now, i will say we've had one in the newsroom, the mini.

jon fort from cnbc has been showing it around. it is absolutely cool. it really is awfully neat. to other news, in just a few minutes the labor department will release the final set of numbers before the presidential election. the big jobs numbers. hard to fathom there's some guy in ohio still waiting for today's data to make a decision. whatever number we get i promise it will be heavily politicized. and restoration hardware will trade shares today on the new york stock exchange with the initial price of $24 a share. it turned out to be a short week for stocks as new york city continues to dry out. let's turn to amanda drury who's live at cnbc world headquarters. good morning, amanda. >> reporter: good morning, scott. yes, futures are slightly lower today ahead of that big data point of the day that you mentioned, the october jobs report. which, as you rightly put it, is the final set of numbers before

election day next week. now, economists are expecting another month of modest but not stellar job growth with forecasts calling for an increase of 125,000 in company pay rolls last month. the unemployment rate for its part is expected to pick up to 7.9%. now, you probably will not see the full impact of hurricane sandy until next month's jobs report. as for stocks, well, they're not open just yet but they rallied just yesterday on the back of positive economic news on both manufacturing and productivity with the dow jumping 136 points, the nasdaq up by 42. and november is historically the best month during a presidential election year for the dow. as for paypal, it's getting into the holiday spirit. it's joining target, walmart and other retailers in offering to match any price. the payment says if you buy anything for the holidays using paypal and see it for less elsewhere, it will ream purse the difference up to $1,000.

this includes even air travel. but, there's always a but, you must submit a refund form, and the receipt, a screen shot of the original price and the lower printed ad. >> thank you very much. jon and laura, we talk about immigration issues on the news but here's an interesting twist. this couple graduated from the university of wisconsin. they started a facebook app that brought in millions of users, but they were here on student visas so they had to leave school and go back home to india. they took their company with them. it's very successful. they were paying $100,000 a year in taxes to the united states when they left. we'll take a closer look at this problem sunday morning. republicans and democrats both say what happened there is a huge mistake. so why can't they solve it? we'll take a look. >> scott, i'm a little salty, we didn't get to touch the new ipad. >> hey, i'm friend with jon at cnbc. >> we'll check it out a little

bit later. we want to check the forecast now with meteorologist, christina loren. the weekend, you can taste it. >> it's one of those weekends you want to get outdoors. as you know it's starting to cool down across the bay area. we'll see a mini heat wave and temperatures approaching records for this time of year. taking a live look at san jose, good morning to you. nice, clear conditions. we're expecting partly cloudy skies to start. definitely not expecting the fog that we had yesterday and that sun will be out just about all day long. increasing clouds toward the second half of the day. so for us this is what we're talking about. 45 degrees. it is cool out there. novato. 50 in sonoma. 54 in stinson beach. 46 in gilroy so 5 to 10 degrees cooler in some cities than this time yesterday. you can see that indicated by the very light blue, the contour levels definitely indicating a colder start. as we head throughout the day today, that area of low pressure swings to our north. high pressure is in control but

we'll see a few showers sneak into the north bay. overall looking towards really comfortable conditions. for your friday, a little fog and drizzle mostly at the coast. by this afternoon the sun comes out warming us up into the 70s. and then this weekend, the 80s return. so highs today are going to be comfortable. they work out like. this beautiful fall day ahead. 60 in santa teresa, 70 in concord, 67 in oaktown and 66 for san francisco. as we get into your weekend, look at this. 80s ahead. it's going to be really, really nice on sunday. that's your better day for outdoor plans. by monday we keep warming you up and tuesday will be the peak. it's going to stay nice and dry and sunny. no excuses not to get out there and rock that vote this year. let's talk to mike about your drive. >> i've got to make sure i'm in the middle. san mateo bridge both sides moving smoothly. looking westbound the commute direction. the high rise clearly visible over here.

for the most part visibility, nothing compared to yesterday. it is completely clear in most of the spots. here on the hayward side, a nice, smooth flow. earlier accidents have reported clear. castro valley y looks very smooth but the volume is target to build coming out of the altamont pass. there is a little fog reported on my contour maps but the slowing likely due to the volume of traffic increasing and no problems reported as far as visibility goes. as christina said, likely clearing from the area. south bay not a problem. easy, breezy drive here. here's 880 and 87. 101 along the peninsula through palo alto all the way up into palo alto. the toll plaza with hardly any folks here and an easy drive down the east shore. it's 5:20. san mateo sheriff deputies need your help tracking down a pair of men who stole more than $7500 from a 7-eleven. police say the two men walked into the store on san mateo road

in half moon bay monday afternoon. one of the men distracted the cashier while the other walked into a rear office and grabbed a bag of cash. the employee didn't notice the money was gone until hours later. some last-minute talks could help stop a potential strike at grocery stores. workers will strike sunday morning if they cannot reach a contract deal. workers rallied in sacramento just yesterday. they say they are fighting for retiree health care. now, if the strike does happen, 32 bay area stores would be affected and this would be the very first strike in the supermarket chain's 80-year history. this is how they got away with it file. palo alto police looking for a shoplifter who walked into a victoria' secret and walked out with $11,000 of bras. officers say an unknown number of people, they took 180 bras from the shop on halloween. they say the store was busy at the time and no one noticed.

welcome back, everyone. this is a live look from the northeast where folks are having to line up for hours just to try to get gas. they sit idle there with their cars having to push them in. a lack of electricity in some areas, a lack of food and water, but red cross even coming in this weekend to give out the meal rationing programs and some bottled water to the folks. they're just having a tough go of it. it's 5:24 right now. the oakland raiders need help from fans this morning. the team needs to sell 85% of

its tickets to home games in order to ensure no blackout. now, as of this morning the team has more than 10,000 tickets short. the nfl gave them a one-day extension. if they don't reach it by today the game on sunday will not be televised. this will be the first game in two seasons to get blacked out. r2d2 may soon help kids learn their abcs. there's new word george lucas will take the bulk of money he's getting from selling lucas films and put into it a charitable foundation. early this week he sold the company to disney for $4 billion. a representative for lucas film telling the hollywood reporter the foundation will support charities that focus on education. very, very nice. >> yeah, very nice. we want to check the forecast as well. it is going to be nice. pretty spectacular for this time

you what's there to meet you along with all the other folks this friday morning. taking a live look outside this morning, isn't that beautiful overlooking san francisco. christina sees the nice weekend ahead. you've made it to friday, november 2nd. this is "today in the bay." good morning to you. thanks for joining us. 5:30. i'm laura garcia-cannon. >> and i'm jon kelley. the oakland police department getting some help this morning and they're getting it from chp officers. this as the city investigates their 108th homicide. christie smith is joining us live from oakland with more on what prompted this call for backup and reinforcement. christie, good morning. >> reporter: good morning to you, jon. this comes at a time when the oakland police department could really use the help. right now they are very short-staffed. major crime is up and the entire police force here in oakland stands at only about 640

officers. compare that with what it was four years ago when oakland had about 840 police officers. so once again they're turning to outside help. the chp. the they have done this before. they did it between 2007 and 2010 with chp officers helping to patrol high-crime areas in the city. during that time police say violent crime went down but the city had to end it for lack of money. exactly how this will be funded this time is still unclear but the city went to governor brown who had to deal with serious crime issues when he was mayor of oakland. after pressure from a local pastor, brown said the state would go ahead and help. so what's happening is this could last for several months with an option to extend it. meantime the city of oakland is planning three police academies, but the first cadets wouldn't even finish and be out on the streets until next fall. reporting live in oakland, christie smith, "today in the

bay." >> thank you. all this help coming just hours after the death of a popular oakland business owner. the memorial for 50-year-old wilbur bartley is growing. this is what it looked like this morning. police say he was closing his cell phone store on international boulevard wednesday night when two men tried to rob him. he was ultimately killed in that altercation. this morning bartley being remembered for all the good he's done in his community. >> kids come by here, man, he'd treat everybody good, you know. the only thing i can think of him doing wrong is being nice. >> bartley and his family lived just a few blocks from his store. we've got breaking news to report this morning. the new month low jobs report has just been released. scott mcgrew in the newsroom with the details. just coming out. >> not bad. 171,000 jobs were added in the month of october. that's a pretty solid number. it's not great, but it's certainly more than we need to cover all the 18-year-olds that

joined the labor force. i've sat in this chair every month and told you it's the total number of jobs that really matters. the unemployment rate rises to 7.9%. in september it was 7.8%. so there is a 0.1 of 1%in cro i in the unemployment rate. this is solidly decent news. i have said in the past the unemployment rate, particular low when it moves just a tenth of a percentage point is not worth paying attention to. th the 171. is it great? no. is it better than we expected? yes, it is. >> and is it going to be blown up, so to speak? the lk is just four days away. good numbers for obama? >> yes, they are, except if i were on the other side of this, what i would play up is the tick up in the unemployment rate, which is what the romney campaign bill do.

>> you can spin it both ways and they will. >> solid numbers. hard to say this is an advantage for either camp. >> thank you very much for getting us those numbers so quickly too. >> you bet. a student at a san jose elementary school is suing the principal, teacher and a school district for negligence and sexual abuse. the lawsuit claiming she was abused by her teacher at o.b. whaly elementary school two years ago and the principal failed to act on those allegations. the criminal trial against the principal is expected to wrap up sometime today. she's facing charges for failing to report the abuse allegations against craig chandler. she admitted in court yesterday she did know about parents' concerns with chandler but didn't report him because she was assured by him he was not doing anything inappropriate. chandler was later arrested and charged with committing lewd acts on five children. this is the second time in 20

years prosecutors have charged a school administrator for not calling authorities in a situation like this. 5:35. the mother of michaela garecht must now wait several more weeks to find out whether a bone fragment found in a well belongs to her missing daughter. a laboratory in arizona is testing the bone to see if it belongs to 9-year-old michaela who disappeared from hayward back in 1988. the fragment was found several weeks ago but test results have been delayed. authorities would not say why. hayward police say it could be another six weeks at least before the tests coming back. the cleanup efforts are under way but all the heart ache and devastation left by hurricane sandy can be seen all over the northeast. a total of 90 people now confirmed dead in ten states and that number unfortunately is expected to continue to rise. but there are some glimmers, some light little peeks of hope out there. in new york more buses and subways are returning to service

every day. that is of course easing the commuting nightmare a lot of people are dealing with. power still out for nearly five million people and there has been a run on gas stations and grocery stores as people flood them trying to stock up on food and try to keep their generators running. the power outage also affecting this aquarium on coney island. staff there say if power is not restored over the next few days, they'll have to temporarily evacuate the marine life to other aquariums until they can get the filtration systems working once again. coney island aquarium is the oldest operating aquarium in the entire nation. that is one of those wild scenes. now, we'll be doing our very own hour-long telethon on nbc to benefit the victims of sandy. the "today" show's matt lauer will be hosting. there will be appearances by kevin bacon, jon stewart, teina

weekend for those candidates and we'll actually have an election to talk about soon. >> reporter: we will, and we will actually have at that some jobs numbers to talk about. they just came out. the nation's new unemployment rate 7.9%. we saw more jobs created, but that rate still ticked up a bit. president obama likely to address that today as he visits ohio. he's also going to be in seven other states between now and election day. in fact he's going to be in ohio every single day, underscoring the importance of that battleground state. governor romney also in ohio tonight at a rally with 100 people who he says are supporters. these are big names. politicians, celebrities, standing behind him tonight. he will likely also talk about those jobs numbers saying that they're just not enough to sustain a recovery and he's got a better plan. meantime analysts are wondering if we could be headed toward a split vote. one candidate, maybe governor romney, winning the popular vote

it's 5:44. the wait coming to an end for some apple customers. the ipad mini hitting stores this morning. bob redell is live in los gatos where people are camping out for today's new ipad release. some even in los gatos camping out in their cars. good morning, bob. >> reporter: they are. it is a little chilly out here. good morning to you, laura. what we are seeing this time around compared to other apple product releases are shorter lines. just take a look at the video we received in the newsroom from overseas. in tokyo, a very large city, the capital of japan, outside one store they saw 300 people lined up. it sounds like a lot of people but it's a population of millions of people and so it's not many. not as many as they saw during the iphone 5 or the 4s for that rather. in sydney, australia, one of their stores saw 50 people lined up outside. the shorter lines could be due to the fact at $330, u.s. prices, the ipad mini is more expensive than similar-sized tablets offered by google and
